Issues For A Prisoner Rights Attorney In NYC

By Enid Hinton

When looking for help with legal issues, individuals often to turn to a civil or criminal lawyer. In most cases, a prisoner rights attorney in NYC is going to be working with felons, and often those who continue to declare innocence which are now on death row. While there are those who promote the death penalty, there are also those who oppose same based on the belief that there are still a number of innocent individuals on death row.

These men and women often either work Pro Bono, or at the very least at fees less than other traditional cases. Those who work Pro Bono need be praised for giving so much free time to do so. Especially, the ones who may have questions with regards to guilt, or innocence but work on a case to get the best deal, if not release possible.

One area in which these individuals often work tirelessly are in cases in which those whom the attorney, or attorneys believe is innocent has been placed on death row for a higher crime, or crimes. It is the innocent within these walls which need the most help. For whether attempting to obtain a Stay from a Governor, or continue to prove innocence, all can take years from when the individual, innocent or otherwise was first charged, jailed and sent to prison.

In other cases, these attorneys work with States to determine if measures being used in the process of the execution are cruel and unusual punishment. California, up until recently had banned the death penalty until the State could prove this was not the case. It would be good if Texas, who has the most executions on record could follow the same procedures.

In one case, a young man defended himself from a knife-welding x-wife, still when the police came, he was the one arrested without question. Neither he nor his x-wife were questioned, he was on parole so he was going to jail. In prison, the young man had the help of an attorney who finally listened to, and believed his side of the story due to past issues on her part.

It will be interesting to see how the prison deals with the situation. Most likely, like in other recent cases, nothing will ever come to pass with regards to the guard who escorted the individual, then killed him. Although, it does seem likely that with new laws set by congress, officers working outside the system may have to start answering from similar crimes, especially those related to the black youth of America.

The U. S. Congress, after researching the recent events in the United States with regards to police murders has now set forth new regulations. Initially, the police forces in the United States and elsewhere were developed to serve and protect the people in a time of need.

It will most likely take years according to one U. S. Congressman who had tried to have the old law revived several times and was met with resistance. It will be interesting to see if the new language has an impact and how rapidly the law will be enforced by the Federal Government. The same Congressman also admits that we can not wait as long as it will take for the bill to be signed into law and go into effect before some action must be taken to stop the madness.
